No entanto, as peças originais foram usadas por alguém que o reconstruiu em outro lugar. Qual dos dois é o navio de Teseu? A lenda versa sobre a Identidade: que mudanças causam sua perda? Em seus estudos sobre Moral, John Locke distinguiu a pessoa do ser humano. Afirmou que as pessoas têm uma identidade que a acompanha por toda vida. Essa identidade, que independe da foto, reside na mente, na consciência que o indivíduo tem de si. Ao contrário do navio de Teseu que com o tempo se deteriorou, a pessoa mantém sua identidade. Ao aplicar o conceito no campo jurídico, Locke concluiu que apenas a pessoa é responsável criminalmente. Se alguém, durante um sonâmbulo, comete homicídio não é passível de punição. Não estando consciente, o sujeito da ação foi o ser humano, não a pessoa. Immanuel Kant, com base no mesmo conceito de pessoa com identidade imutável, justificou a pena capital para quem comete o homicídio. Kant não via a Igualdade apenas como direito de todos às mesmas oportunidades. Para ele a Igualdade é também uma questão de dever. Se uma pessoa tira a vida de outra, deve receber exatamente igual tratamento que impôs à sua vítima. Similar argumento já tinha sido defendido por Tomás de Aquino e posteriormente por outros pensadores. A tese passou a ser conhecida com “Retributivismo”.
